Core Principle

A DISCLAIMER SETS REALISTIC EXPECTATIONS AND LIMITS LIABILITY — IT DOES NOT ELIMINATE ALL RESPONSIBILITY, BUT IT DOES PROTECT AGAINST UNREASONABLE CLAIMS.

All placed on dedicated /disclaimer page and linked from footer, with earnings disclaimer additionally on sales pages.


Anti-Patterns

  • No disclaimers at all — leaving your site without disclaimers when you make results claims, give advice, or use affiliate links is unnecessary risk
  • Hiding disclaimers in tiny text — disclaimers should be readable and accessible. A disclaimer no one can find may not protect you.
  • Disclaiming everything to avoid all responsibility — a disclaimer cannot override consumer protection laws or cover fraud. Be reasonable.
  • Copy-pasting from another business — customize for your specific products, services, and claims
  • Disclaimers that contradict your marketing — if your sales page promises "guaranteed results" and your disclaimer says "no guarantees," that is a problem

Recovery

  • Already making claims without disclaimers: Add disclaimers immediately. Update marketing materials to ensure claims are not misleading.
  • FTC complaint about missing affiliate disclosure: Add disclosures to all affiliate content retroactively. The FTC requires clear and conspicuous disclosure.
  • Customer relies on your content and suffers a loss: The disclaimer limits liability, but consult an attorney. If your content was genuinely negligent, a disclaimer may not provide full protection.
  • Operating in a regulated industry: Standard disclaimers may not be sufficient. Consult an industry-specific attorney for compliance requirements.
